1. General

These terms and conditions govern the use of this website and the coaching services offered by Walerij LLC. By accessing this website or engaging our services, you agree to be bound by these terms.

Coaching Services Agreement & Disclaimer

2. Nature of the Relationship

The Client understands that Walerij LLC provides 1:1 solopreneur performance coaching. This is a professional-to-professional relationship designed to facilitate the development of business goals, performance habits, and strategic thinking.

3. "HumanOS" & Scope of Practice

While the Coach uses the term "HumanOS," this refers to the study of mindset, behavioral patterns, and cognitive frameworks as they relate to high-performance solopreneur environments.

Not Therapy: The Coach is a professionally trained NLP and Hypnosis Coach, not a licensed psychologist, psychotherapist, or medical professional.
Focus: Coaching is future-oriented and focuses on populations seeking performance optimization. It is not designed to treat, diagnose, or cure clinical mental health disorders as defined by the DSM-V or ICD-11.
Referral: If the Coach determines that the Client's needs fall outside the scope of coaching (e.g., clinical depression, anxiety disorders, or trauma requiring therapeutic intervention), the Coach reserves the right to terminate the session and refer the Client to a licensed mental health professional.

4. Mental Health Disclaimer

The Client is responsible for their own physical, mental, and emotional well-being. Coaching is not a substitute for professional mental health care or substance abuse treatment. If you are currently under the care of a mental health professional, it is recommended that you inform them of your intention to work with a coach.

5. Professional Responsibility & Results

Client Autonomy: The Client acknowledges that they are solely responsible for all decisions, actions, and results arising from the coaching relationship.
No Guarantees: The Coach makes no guarantees or warranties, expressed or implied, regarding specific outcomes, financial gains, or business success.
Advice vs. Coaching: Any suggestions or "advice" offered by the Coach are for educational and brainstorming purposes only. The final responsibility for implementing any business strategy or personal change rests entirely with the Client.

6. Limitation of Liability

To the maximum extent permitted by law, the Coach shall not be liable for any indirect, consequential, or special damages. The Coach's total liability under this agreement shall be limited to the total amount paid by the Client to the Coach for the services rendered.

7. Confidentiality

The Coach will maintain the strictest confidentiality regarding all Client information, except as required by law (e.g., immediate threat of harm to self or others). Please note that the coach-client relationship is not "privileged" in the same way a doctor-patient or attorney-client relationship is.

8. Termination

Either party may terminate the coaching relationship at any time with 14 days' written notice. In the event of termination, the Client remains responsible for payment for services already rendered.

General Provisions

9. Payments

Payment terms will be agreed upon before the commencement of coaching services. All fees are non-refundable unless otherwise specified in writing. Late payments may result in suspension of services.

10. Cancellation Policy

Sessions may be rescheduled with at least 24 hours notice. Cancellations with less than 24 hours notice may be charged in full. We reserve the right to reschedule sessions due to unforeseen circumstances.

11. Intellectual Property

All content on this website, including text, graphics, and frameworks, is the intellectual property of Walerij LLC unless otherwise stated. Unauthorized use or reproduction is prohibited.

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of New Mexico, United States. Any disputes shall be subject to the exclusive jurisdiction of the courts of New Mexico, USA. For users in the European Union, mandatory consumer protection provisions of EU law remain unaffected.

13. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting on this website. Continued use of our services constitutes acceptance of the modified terms.
